Sealing or Resealing of Foreign Inheritance in Hong Kong: Overview

According to section 49 of the Probate and Administration Ordinance, if a grant of representation has been obtained in a designated jurisdiction in respect of the estate of a deceased person, the Court of Hong Kong may, on application by the applicant, complete the proceedings of representation in Hong Kong by sealing the grant of representation obtained in the designated country. The designated jurisdictions where the sealing procedure can be applied include Sri Lanka, Singapore, New Zealand, the Australian states of Tasmania, Victoria and South Australia and the Northern Territory, and the United Kingdom.

Sealing or Resealing of Foreign Estates in Hong Kong: Features

By applying for sealing or resealing in the Hong Kong Court of an estate obtained in a designated country, this method is characterized by its simplicity compared to the usual procedure of applying for an estate. (1) The solicitor can sign the affidavit on behalf of the applicant, and the applicant does not need to come to Hong Kong to sign the document, and generally does not need to go through the formalities of notarization of the oath in a foreign country; (2) The Hong Kong court uses the undertaker named in the undertaking obtained in the designated country as the undertaker in Hong Kong and generally does not make too many enquiries or interferences.

To apply for sealing or resealing in Hong Kong by applying to the Hong Kong court of an estate obtained in a designated country, the main document required is the foreign grant, which needs to be either the original court-sealed document or a copy certified by the foreign court.

Sealing or Resealing of Foreign Inheritance in Hong Kong: Guarantees

In order to apply for sealing or resealing in Hong Kong court of an estate obtained from a designated country, the Hong Kong court may require the applicant to provide security under certain circumstances. The common situations are mainly where the beneficiaries of the estate are minors or where the applicant’s domicile is outside Hong Kong. In some cases, we can apply to the Court on behalf of our clients to be exempted from security.
